The bill would give “the industry and investors and regulators an easier path forward,” she said, because it establishes very clear lines about who has authority over the crypto spot market. The CLARITY Act draws a legal distinction between digital assets classified as commodities and those classified as securities. It assigns regulatory jurisdiction to either the SEC or the CFTC depending on the asset. For XRP, which already has established regulatory clarity following its legal battle with the SEC , a clear statutory framework could reinforce its position and expand the legal certainty institutional investors need. It needs 60 to clear the filibuster. The Senate departs for recess on August 8. The bill has not been scheduled for a floor vote. Senate Majority Leader John Thune has prioritized other legislation, and no cloture filing has been publicly confirmed. If the Senate does not act before recess, the bill moves to September at the earliest. Recent reports suggest 7 to 10 Democrats are ready to support the bill .
